Membership Terms

English translation. This is an unofficial translation provided for your convenience. The Japanese version is the authoritative text; if the two differ, the Japanese version prevails.

Article 1 (Scope)

These Terms govern the rights and obligations between YU-YU-YU (“we”, “us”) and its members in relation to the membership service and card purchasing service (the “Service”) that we provide.

Article 2 (Definitions)

  1. “Member” means an individual who has agreed to these Terms and completed registration by the method we prescribe.
  2. “Purchase” means our buying of trading cards or similar items owned by a Member.

Article 3 (Registration)

  1. Registration is completed by logging in with a Google or LINE account and entering the details we require.
  2. Registration is free of charge.
  3. We may refuse registration if we determine that the details provided are false, or for any other reason we consider inappropriate.

Article 4 (Eligibility)

Registration is available only to persons who meet all of the following conditions.

  1. Resides in Japan
  2. Holds a bank account in their own name (where payment by bank transfer is requested)
  3. Agrees to these Terms and to the Privacy Policy

Article 5 (Use by Minors)

  1. Minors must obtain the consent of a parent or guardian before applying.
  2. We may ask to confirm with a parent or guardian before purchasing cards.
  3. We purchase cards from persons under 18 only where a written consent form from a parent or guardian has been submitted to us. Without that consent form, we will decline the purchase.
  4. The consent form may be submitted either in store or by sending it to us through our official LINE account.

Article 6 (Accuracy and Updating of Registered Details)

  1. Members shall keep their registered details accurate and up to date.
  2. If your details change, please update them promptly from the “Edit your details” page after logging in.
  3. We are not liable for any disadvantage arising from inaccurate registered details. In particular, we are not liable for delayed or failed transfers caused by incorrect bank account details.

Article 7 (Account Management)

  1. Members are responsible for managing the Google or LINE account they use to log in.
  2. Any use of the Service through that account is deemed to be use by the Member.

Article 8 (Purchase Requests and Identity Verification)

  1. Purchase requests are made in store.
  2. Under the Antique Dealings Act, we require you to present official photo identification when we purchase cards from you. If you cannot present it, we will decline the purchase.
  3. The details recorded on your identification document are recorded and retained as required by law.

Article 9 (Appraisal and Purchase Prices)

  1. Purchase prices are determined by our appraisal, taking into account the condition and authenticity of the item, stock availability and market rates.
  2. The purchase prices shown on this site are a guide for items in good condition at the time of posting. Actual prices are determined by appraisal, and the posted prices are not guaranteed.
  3. A pre-appraisal via our official LINE account is an estimate only and is not a final figure.
  4. A purchase contract is formed when the Member accepts the appraised amount we present.

Article 10 (Items We Will Not Purchase)

We will decline to purchase the following items.

  1. Counterfeit or reproduction items, or any item we judge not to be genuine
  2. Stolen items, or items suspected of having been obtained unlawfully
  3. Items so badly damaged or soiled that they have no resale value
  4. Any other item we judge unsuitable for purchase

Article 11 (Payment)

  1. We pay for cards either in cash at the store or by bank transfer to your registered account. Where payment is by transfer, we process it within two business days after the purchase is agreed.
  2. Where payment is by bank transfer, the account must be in the Member’s own name. If the name does not match the account holder name, we may be unable to make the transfer.
  3. Transfer fees are deducted from the purchase price.

Article 12 (Cancellation After a Purchase)

Once a purchase contract has been formed, we cannot accept cancellation or return at the Member’s convenience, except where the law provides otherwise.

Article 13 (Prohibited Conduct)

Members must not do any of the following when using the Service.

  1. Acts that violate the law or public order and morals
  2. Registering or declaring false information
  3. Bringing in counterfeit, stolen or otherwise unlawful items
  4. Using the Service while impersonating another person
  5. Interfering with our business
  6. Unauthorised access or other acts that interfere with the operation of the Service
  7. Any other act we consider inappropriate

Article 14 (Exclusion of Organised Crime Groups)

Members represent and warrant that they are not a member of an organised crime group (boryokudan) or any equivalent party. If it emerges that they are, we will refuse use of the Service immediately.

Article 15 (Suspension and Withdrawal)

  1. If we determine that a Member has breached these Terms, we may suspend their use of the Service or cancel their registration without prior notice.
  2. Members who wish to withdraw should notify us in store or by phone.
  3. Even after withdrawal, transaction records that we are required by law to retain are kept for the period prescribed by law.

Article 16 (Disclaimer)

  1. To the extent permitted by law, we make no warranty as to the accuracy or effectiveness of the content of the Service.
  2. We may temporarily suspend the Service due to communication line or system failures. We are not liable for any loss to Members arising from this, except where caused by our wilful misconduct or gross negligence.
  3. We are not liable for losses arising from fluctuations in market rates.

Article 17 (Handling of Personal Information)

The handling of Members’ personal information is governed by our separate Privacy Policy.

Article 18 (Changes to These Terms)

We may amend these Terms where we consider it necessary. Where an amendment is disadvantageous to Members, we will post the content of the amendment and its effective date on this site a reasonable period before it takes effect.

Article 19 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. In the event of a dispute concerning the Service, the Shizuoka District Court shall have exclusive jurisdiction in the first instance.
